Indicators of 2014 Public Procurement, Tender Procedures, Clients and Competitiveness at Durres Municipality

Open Data Albania is investigating on indicators of the public procurement process in those municipalities where mayors have been reelected for another term during Local Government Elections of 21 June 2015. Mr Vangjush Dako, Major of Durres Municipality, was re-elected for a third term. The research was focused on public procurements announced in the twelve months of 2014. The indicators provide information on the number of procurement procedures, the structure by type of procedure, the tendered amounts and their distribution by customers. The analysis is especially focused on competitiveness procedures according to tenders categorized in four levels: with one operator due to lack of competitiveness, with two to three operators, with four to ten operators or more than ten operators (high competitiveness).

In 2014, the Municipality of Durres announced 82 procurement procedures, out of which 27 procurements were held under open procedures; 49 coincided with request for proposal; 2 procedures with consultancy service and 4 procurements were conducted with direct negotiations amounting to ALL 23.9 million.

From the 82 procedures announced, 67 were finalized with the announcement of the winner and endorsement of a contract. In 4 procurement procedures out of 67 finalized procedures, the winner and the contract agreement were announced in the following year, 2015. Fifteen procedures of procurement were cancelled due to problems with the documentation submitted.

Fifteen canceled procedures had a total limit fund of ALL 105 million. While as per 67 procedures finalized with contract signature, the limit fund differed from the offered fund,  which amounted to ALL 499 million, or 23% of the limit fund announced for these 67 procedures.

In two cases, the limit fund in the announcement was identical with the fund submitted by the winning operator. Specifically, these cases are written in the procurement procedure "Purchase of firewood for Economic Education Centre" and "Purchase of fuel for Durres Municipality and institutions under its subordination". The amount for both these procedures was ALL 50.49 million. The Limit Fund is the value of the procurement announcement. The value of the contract shall not exceed the Limit Fund announced.

From the contracted fund amounting to ALL 1.64 billion, ALL 202 million were spent for the Purchase of Goods in 26 cases. In 15 cases, the amount was spent for Public Services and in 26 procedures object of procurement were public works, which were either constructed or reconstructed. Public works also occupy 83% of the total value of the contracted fund.

In order to make an assessment by competitiveness a categorization according to the number of operators that participate in the competition is necessary. Procedures without competitiveness are considered those procedures in which only one bidder is presented and direct negotiations are held. Only 3.42% of the Value Contracted from the Municipality of Durres in 2014, is tendered without competitiveness, or with a single competitor. 59% of the contracted fund, or 17 tenders conducted by the Municipality were characterized by a high level of competitiveness with the participation of over 10 competing operators.

Only 49 entities won in 67 procured procedures. In 12 cases, entities or merged entities were announced winners in two or more tenders, while in one case the winning entity is a Natural Person. Eurndertimi 2000 SHPK Company is ranked the first because it has won tenders as a sole entity in four cases. In these four cases the contracted value was ALL 145.23 million. It has also gained in two tendering procedures where it had applied in cooperation with Everest SHPK , with a contracted value worth ALL 205.54 million.

Eurondėrtimi is the company that has been working for the reconstruction of Porto Romano road, Dyrrah Sheshi Liria segment, Tasim Kėlliēi street, Bajram Curri Street reconstruction, construction of Bicycle lane road, Greenery and Construction  of Pavaresia road, construction of the Square before Tirana Bank building. The two recent works were carried out in cooperation with Everest SHPK company. Start Co SHPK and Kastrati SHA   companies, which have gained three procedures with a contracting value respectively ALL 39.79 and ALL 24.17 million rank the second.

Concerning the contracted amounts, the most important client of Durres Municipality in 2014 is Everest SHPK Company, which is the winner as a sole competitor in two tenders, where the total value of the contract amounted to ALL 251.21 million. Only for the procedures where it has competed alone, Everest SHPK had a weight of 15% of the total fund procured by Durres Municipality.

This company has won in cooperation with Eurondėrtimi SHPK Company in two other tenders amounting to ALL 205.54 million, or 12 % of the total fund. Fusha SHPK, company ranks the second as far as the contracted value is concerned, with an amount of ALL 239.87 million, approximately 15% of the total fund. This company has built the parallel road to Durrės Port.

Definitions: Law on Public Procurement specifies some procedures concerning the implementation of contracts that have as an object: Work, Services, or Purchasing of goods with public funds:

Open procedures are procedures where any interested economic operator may submit a bid.

Limited procedures are procedures whereby only economic operators selected by Contracting Authority are entitled to submit a bid. Restricted procedures are applied for cases where certain technical, professional or financial capacities are necessary for goods, services, or public works. The law also provides for that the contracting authority may also select an operator that it considers as the most economically efficient.

Request for Proposal are procedures when the contracting authority requires bids from a limited number of economic operators it has selected, but accepts even offers presented by other economic interested operators;

The procedures for Consulting Services are of an intellectual and advisory nature and don?t include other types of services where the physical aspects of the activity predominate;

Procedures with Design Competition are all those procedures during which a jury set up for the competition process by the Contracting Authority selects a study, or a project that entirely have an aesthetic nature mainly in the field of urban, rural, architectural planning etc.

The law provides for Procedures with Negotiations in all cases when the above procedures result unsuccessful, bidders become invalid, or don?t meet the requirements of the national legal provisions. This is also true for emergency cases, cases when the copyright must not be infringed, or when goods are quoted on the stock exchange. In the case of the negotiated procedure the contracting authority selects personally the economic operator and establishes the terms of the contract.

Negotiated procedures are also applied in case of additions to contracts, supplement work or services, which were not included in the initial contract, but due to unforeseen circumstances have become necessary. Supplements to the contract are also applied when additional constructions, or services cannot be separated from the original contract without causing major technical and economic difficulties to the Contracting Authority provided that the additional value does not exceed 20% of the value of the initial contract.
